KRCL Defense Team Obtains Zero Defense Verdict in a Residential Construction Case
The defense team of Chris Pappas, Roland Hamilton, David Mullican, Laura Garcia and local counsel Scott West of the West Law Firm obtained a zero defense verdict in a residential construction case filed in Fort Bend County. Plaintiffs were seeking $2 Million in damages and claimed causes of action for negligence, breach of contract, fraud, DTPA violations, and breach of warranty. Plaintiffs also sought to pierce the corporate veil to get to the personal assets of the president of the company. Mold growth and deterioration of portions of the structure of the home were present. However, Mr. Pappas and his team were able to convince the jury of Plaintiffs' failure to mitigate their damages and properly maintain the home over the fourteen-year period during which they owned it.
